These Terms of Use govern access to and interaction with this website and the subscription services provided through it. By using the site and subscribing to a plan, the user (hereinafter "Client") confirms that they have read, understood, and accepted these terms.

Use of the website
Acceptable use The Client may browse, interact with, and utilize the materials and services available on the website, provided such actions remain lawful and do not disrupt the functionality or security of the platform. All access must be conducted in good faith and in compliance with industry standards.
Prohibited actions The Client must refrain from attempting unauthorized access to internal systems, copying or extracting significant portions of the website, interfering with technical operations, exploiting vulnerabilities, or using automated tools in ways that burden or manipulate the platform. Misuse of any AI-related features, including attempts to reverse-engineer proprietary logic or datasets used in our backend, is strictly prohibited.
Intellectual property
Ownership of Platform All content, designs, structures, branding elements, texts, visuals, and underlying AI-automation frameworks available on the website (excluding Client deliverables) are owned by the Konstantine Group or licensed for its use. These materials remain protected by relevant intellectual property laws.
Ownership of Deliverables Upon full payment of the subscription fees, the Client obtains full ownership rights to the specific AI integrations, automations, and custom workflows (the "Deliverables") created specifically for the Client during the subscription period. Konstantine Group retains the right to use general knowledge, code snippets, and methodologies developed during the process for other projects, provided no confidential Client data is disclosed.
Service Information and Subscription Terms
The "Growth" and "Scale" Plans The services are provided on a recurring subscription basis.
Growth Plan ($4,500/mo): Includes one (1) active request at a time, one Senior AI Specialist, and unlimited revisions.
Scale Plan ($7,500/mo): Includes two (2) active requests at a time, two Senior Specialists, and unlimited revisions.
Turnaround Times While we aim for a 48-hour turnaround on standard requests, this is an estimate and not a guarantee. Complex AI integrations may require longer development times. In such cases, the Client will be notified of the estimated timeline.
Pause and Cancellation The Client may pause or cancel their subscription at any time.
Pause: If a subscription is paused, the remaining days in the current billing cycle are preserved and can be used when the subscription is reactivated.
Cancel: Cancellation stops the auto-renewal. The service remains active until the end of the currently paid billing period.
No Refunds Due to the nature of the work and the allocation of resources, refunds are not issued for time spent. We do not offer refunds for partial months or unused time if the Client fails to submit requests. The "Pause" feature is the mechanism provided to save unused time.
User content
Submissions The Client is responsible for providing all necessary data, API keys, access credentials, and clear instructions required for the Konstantine Group to perform the services.
Responsibility The Client represents that they own or have the necessary rights to use all content, data, and third-party software accounts provided to us. The Client is solely responsible for ensuring that the resulting AI agents and automations comply with applicable laws (e.g., GDPR, UWG) in their specific industry.
External links and Third-Party Tools
Third-party resources Our services rely on third-party AI providers and tools (e.g., OpenAI, Stripe, Vercel, ElevenLabs). We act as an integrator of these tools.
Independent responsibility We are not responsible for changes in pricing, service outages, or policy changes by these third-party providers. The Client is responsible for any direct costs associated with their own third-party accounts (e.g., OpenAI API credits) unless otherwise agreed.
Limitation of liability
General limitation To the extent permitted by applicable law, Konstantine Group is not responsible for damages arising from the use of the website, temporary unavailability, or business losses (e.g., lost profits) resulting from the use of the AI agents created.
German Statutory Liability (Haftungsbeschränkung) As a German entity, our liability is governed as follows:
We are liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), and for injuries to life, body, or health.
In cases of slight negligence, liability is limited to the breach of essential contractual obligations (Kardinalpflichten), and compensation is limited to the typically foreseeable damage at the time of the contract.
Konstantine Group does not guarantee specific sales results or business outcomes from the use of the AI integrations.
Changes to terms
Right to modify We reserve the right to update or modify these Terms of Use at any time. Changes become effective immediately upon publication. Continued use of the site or subscription after adjustments signifies acceptance of the updated terms.
Governing Law
Jurisdiction These terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany, provided the Client is a merchant or legal entity under public law.
